Judge dismisses charges against father-son duo accused of shooting at Black FedEx driver
SUMMARY: Charges against Gregory and Brandon Case, accused of shooting at Black FedEx driver D’Monterrio Gibson in Brookhaven, have been dropped. In November 2022, the duo faced attempted murder and conspiracy charges, but a mistrial led to the dismissal of their cases due to the Brookhaven Police Department’s detective, Vincent Fernando, allegedly withholding crucial evidence. This included a videotaped interview with Gibson. The judge ruled the defendants were denied due process and a fair trial, citing “numerous intentional discovery violations.” Therefore, the Cases cannot be retried for these offenses, as their charges have been dismissed with prejudice.
