Louisiana Supreme Court upholds state authority to clear homeless encampments | Louisiana
SUMMARY: The Louisiana Supreme Court has affirmed the state’s authority to clear unauthorized homeless encampments from public property, overturning a lower court’s injunction that temporarily halted such actions. This decision supports state agencies, including Louisiana State Police, in enforcing laws aimed at public health and safety. The controversy began when police issued “Notice to Vacate” flyers to encampment residents ahead of major events in New Orleans. Following legal challenges, the Supreme Court ruled that the lower court’s actions interfered with state powers. The ruling emphasizes the balance between public safety and compassion in addressing homelessness, which remains a significant challenge in Louisiana.
