Judge dismisses lawsuit seeking to protect dolphins along the Mississippi Gulf Coast
SUMMARY: A federal judge has dismissed a lawsuit aimed at protecting dolphins along the Mississippi Gulf Coast after the 2019 opening of the Bonnet Carre’ Spillway led to numerous dolphin deaths. U.S. District Judge Louis Guirola Jr. ruled that the Mississippi Sound Coalition lacked legal standing, as they could not demonstrate imminent harm from future spillway operations. The coalition argued that the Army Corps of Engineers should secure permits under the Marine Mammal Protection Act, but the judge found their claims speculative, noting no evidence of dolphin harm during previous openings in 2016, 2018, and 2020.
