SUMMARY: The Pacific Legal Foundation and Do No Harm are suing Tennessee over racial quotas for appointments to state boards and commissions, arguing they violate the 14th Amendment. The lawsuit targets the Board of Medical Examiners and Board of Chiropractic Examiners, claiming that requiring the governor to appoint members based on race undermines individual merit. The groups also challenge similar racial requirements for the Board of Podiatric Medical Examiners. The lawsuit highlights concerns about patient safety and the importance of appointing qualified individuals, regardless of race. However, the labor force participation rate has declined to 59.4%, significantly below the national average of 62.7%. Dr. Don Bruce from the University of Tennessee attributes this decline partly to the in-migration of retirees and educational pursuits. Despite a low unemployment rate, Tennessee faces 64,000 unfilled jobs due to geographic and skill mismatches. Per capita income in Tennessee is $62,229, still below the national average of $69,810 but closing the gap.
