Federal appeals court panel rules state voting law violates US Constitution
SUMMARY: The US Fifth Circuit Court of Appeals has ruled that a Mississippi voting law is unconstitutional. The law, Section 241 of the Mississippi Constitution of 1890, prohibits anyone convicted of certain crimes from voting even after their sentence is complete. A group of Mississippians sued, arguing that this law violated the Eighth Amendment’s prohibition against cruel and unusual punishment. The court agreed and determined that the Secretary of State cannot enforce this law. However, the court rejected the group’s claim that another section of the constitution violated the US Constitution. The Mississippi Attorney General is expected to request a reconsideration of the ruling.
