Kentucky wins federal court case against EPA | Kentucky
SUMMARY: A federal appeals court has ruled in favor of Kentucky, stating that the U.S. Environmental Protection Agency (EPA) failed to follow established law in rejecting the state’s Clean Air Act compliance plan. The Sixth Circuit Court found that the EPA took too long to respond and used inconsistent criteria in its decision. Kentucky’s plan, submitted in January 2019, indicated no further ozone reduction was necessary based on the EPA’s initial guidelines. The court’s ruling vacates the EPA’s decision and mandates reconsideration of the state’s proposal. Kentucky officials emphasized the importance of affordable energy and criticized the EPA’s approach.
