States say court must block Department of Education’s Title IX rule | National

SUMMARY: This month, states and private organizations requested the Eleventh Circuit Court of Appeals to overturn a district court’s decision permitting the Biden administration’s expanded Title IX rules, which include gender identity in sex discrimination laws. Alabama, Florida, Georgia, and South Carolina seek a preliminary injunction against the Department of Education, arguing they are similarly situated to states already granted relief. The Department contends that noncontroversial aspects of the rule should go into effect. Legal battles have blocked the implementation of the rule in over half of the states and many educational institutions, delaying enforcement amid ongoing litigation.
